1. Acceptance of Terms By enrolling in classes with us, purchasing services or merchandise, attending our events, or accessing or using our website located at tsdpac.com (the "Website"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and Tiffany's School of Dance and Performing Arts Center. They apply to all students, parents, guardians, customers, clients, and any person who visits or uses the Website. These Terms incorporate by reference all other policies, rules, and guidelines the Studio posts on the Website or otherwise makes available now or in the future, including our Privacy Policy, each of which forms part of this agreement. Your continued use of the Services constitutes acceptance of those policies as amended from time to time. If you do not agree to these Terms, you must not enroll in classes or use the Website.
2. Definitions "Studio," "we," "us," or "our" means Tiffany's School of Dance and Performing Arts Center. "You" or "User" means any student, parent, guardian, customer, client, or person who enrolls in classes, purchases services or merchandise, attends our events, or accesses or uses the Website. "Services" means the classes, instruction, recitals, performances, events, merchandise, and all content and functionality made available through the Website or by the Studio.
3. Eligibility The Services are intended for individuals who are at least eighteen (18) years of age, or for minors under the supervision of a parent or legal guardian who agrees to these Terms on the minor's behalf. By enrolling a minor or permitting a minor to use the Services, you represent that you are the parent or legal guardian, and you accept full responsibility for the minor's use of the Services and compliance with these Terms.
4. Enrollment & Registration
● Registration is complete only upon receipt of a completed enrollment form and applicable fees.
● Enrollment constitutes agreement to all studio policies.
5. Tuition & Payments
● Tuition is due on the 1st of each month.
● A late fee of $_50.00____ may be applied to payments received after the due date.
● Tuition is non-refundable once the month has begun.
● Returned checks may be subject to a returned check fee of $55.00______.
6. Attendance
● Regular attendance is expected of all students.
● You are required to notify us in advance for any absences.
● Tiffany's School of Dance is not responsible for missed instruction due to absences or tardiness.
● Any students who are late or miss classes on a regular basis may be asked not to return, in our sole and absolute discretion. If a student is asked not to return, tuition and fees already paid for the then-current month are non-refundable.
7. Recitals & Performances
● Participation in recitals/performances may require additional costume and/or production fees.
● These fees are non-refundable once costumes have been ordered.
8. Code of Conduct
● Students and parents/guardians are expected to treat staff, instructors, and other students with respect.
● The studio reserves the right to dismiss any student or family whose behavior is disruptive or disrespectful.
9. Photography & Media
● Tiffany's School of Dance may photograph or video students during class or performances for promotional purposes.
● If you do not wish your child to be photographed, please notify us in writing at tiffany@tsdpac.com.
10. Website Use & Acceptable Use.
1. You agree to use the Website and Services only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the Website in any manner that could disable, overburden, or impair it; (b) attempt to gain unauthorized access to any portion of the Website or its related systems; (c) use any robot, scraper, or other automated means to access the Website; (d) introduce any viruses or malicious code; or (e) use the Website to transmit any unlawful, harassing, defamatory, or infringing material. We reserve the right to suspend or terminate your access to the Website at any time, without notice, for conduct we believe violates these Terms or is harmful to us or others.
11. Intellectual Property.

All content on the Website, and all choreography, routines, music selections, logos, branding, trademarks, text, graphics, images, and materials created by or for the Studio, are the property of Tiffany's School of Dance and Performing Arts Center and are protected by applicable intellectual property laws. Students and families must obtain written permission before performing any Studio choreography at outside events such as talent shows, church events, or festivals, and may not distribute, post, or share choreography on any platform without permission. Use of the Studio's name, logo, or branding requires prior written approval. You may not reproduce, distribute, or create derivative works from any Studio content without our prior written consent.
12. User Content & Social Media. Students, parents, and guardians are expected to conduct themselves respectfully online. Social media posts that portray the Studio, its staff, students, or other studios in an unfavorable or negative light are prohibited. Content may not be recorded or created on Studio property without permission from a teacher or staff member. If you submit any content to us, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services.
13. Third-Party Links. 3. The Website may contain links to third-party websites or services that are not owned or controlled by the Studio. We are not responsible for the content, policies, or practices of any third-party sites, and your use of them is at your own risk.
14. Liability Waiver
● Dance instruction involves physical activity. Tiffany's School of Dance and Performing Arts Center is not liable for injuries that occur during normal class participation. Any participant will be required to sign a waiver.
● By enrolling, you acknowledge this risk and agree to hold the studio harmless.
15. Disclaimer of Warranties. 4. The Website and Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, secure, or error-free, or that any defects will be corrected. 5.
16. Limitation of Liability. To the fullest extent permitted by law, in no event shall the Studio or its owners, instructors, staff, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or Services. Our total aggregate liability for any claim arising out of or relating to these Terms, the Website, or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
17. Indemnification. You agree to indemnify, defend, and hold harmless the Studio and its owners, instructors, staff, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services or Website, your violation of these Terms, or your violation of any rights of a third party.
18. Termination
● Either party may terminate enrollment with 30 days written notice.
● The studio reserves the right to terminate enrollment without notice for violations of the code of conduct. 6.
19. Governing Law & Dispute Resolution. These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, the Website, or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Onondaga County, New York, and you consent to personal jurisdiction in those courts. 7.
20. Privacy. We respect your privacy and handle personal information in accordance with our Privacy Policy. By using the Website and Services, you consent to the collection and use of your information as described in that policy. 8.
21. General Provisions. Entire Agreement. These Terms, together with any policies referenced herein, constitute the entire agreement between you and the Studio and supersede all prior agreements and understandings. Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later. Assignment. You may not assign these Terms without our prior written consent; we may assign these Terms without restriction.
22. Changes to Terms. We reserve the right to update these terms or any policy at any time, and when we do so we will post same on our website and email a version (or link to new terms on our website) to current customers’ email address (receipt of the email is not needed for update). Once the new version is posted on our website, it controls. You agree to this by continued use of our services. Continued enrollment constitutes acceptance of updated terms.
23.SMS/Text Messaging Terms
By opting in to receive SMS/text messages from Tiffany's School of Dance and Performing Arts Center, you agree to receive recurring text messages related to our programs and services. Messages may include enrollment information, class and schedule updates, event information, studio announcements, special offers, promotions, and other marketing communications.
Consent to receive marketing text messages is not a condition of purchase or enrollment. Message frequency may vary.
Message and data rates may apply.
You may opt out of SMS/text messages at any time by replying STOP to any message. After you send STOP, you may receive a confirmation message indicating that you have been unsubscribed. For assistance, reply HELP or contact Tiffany's School of Dance and Performing Arts Center using the contact information provided in these Terms.
Wireless carriers are not liable for delayed or undelivered messages.
Age Requirement: You must be at least 18 years old to opt in to receive SMS/text messages from Tiffany's School of Dance and Performing Arts Center. If you are under 18, a parent or legal guardian must provide consent on your behalf.
